It is highly important to note that every DIN holders’ are mandatorily required to update their KYC to the Registrar of Companies every year as per Companies (Appointment and Qualification of Directors) Rules. Recently the said rules have been amended to make the following changes including due date for filing the same. (w.e.f 25th July 2019)
a. Due date for filing the same is now 30th September of every year.
b. How to file/update the KYC
Situation-1:
When eForm DIR-3-KYC is filed last year and it is required to update the details further in it, the same to be filed using eForm DIR-3 KYC
Situation-2:
When first time KYC required to be filed the same to be filed using eForm DIR-3 KYC
Situation-3:
When eForm DIR-3-KYC is filed last year and it is NOT required to update the details further in it, the same to be filed using DIR-3-KYC-WEB
Penalty for non-filing / updation of KYC by DIN holders
Penalty of Rs.5000/- to be paid at the time of delayed filing
Consequences for non-filing / updation of KYC by DIN holders
DIN will be deactivated in such a way that the DIN holder may not be able to file any eForm before Ministry of Corporate Affairs in compliance with the provisions of Companies Act, 2013
